Legal Notices and Privacy policy

NOTICE SPECIFIC TO DOCUMENTS AND INFORMATION AVAILABLE ON THIS WEBSITE

This is generic boilerplate of legal notices and a privacy policy. Some of it may not actually apply at this point. For instance, I am not going to be asking for your credit card number right now, but I might later, so the verbiage is there. This is one of those projects which should be done once and not have to worry about in the future, but change is inevitable, so please check back once in a while for updates. Thanks for actually reading this!

Actually, since the initial composition of this notice, we are now doing business on the web, where your credit card might be required if you so choose to purchase something. We are using PayPal as our facilitator of secure credit card transactions. You can visit PayPal's web site for more information.

The principle behind this policy, and our business, is to only collect information with your knowledge and consent.

Personally Identifiable Information

W do not share your personally identifiable information with third parties without your permission. We may partner with companies that offer specific products/services to our customers, prospective customers, Independent Sales Representatives, and site visitors. These partner/provider companies offer their products/services under their brand name, and if you choose to sign up for our services under the brand name of our partner company, we may share personally identifiable information with that company. For example, The XYZ Company and ourselves have created a partnership. If you use the benefit provided by The XYZ Company, or a visitor to their website, and you have purchased our services, we may share personal information with The XYZ Company in obtaining their product. Here is a specific example. If you order a magazine, your information may be shared with the company that provides fulfillment services for that magazine, and with the publisher of the magazine that you ordered. This kind of shared personal information is simply to process your order and to provide you with better customer service.
Also, we will never sell, share or rent information we receive from other companies about you to outside parties. We may use this information ourselves, only to personalize and enhance the content of our service and to specialize any promotional offers from us.

Credit/debit card information

Credit/debit card information is never shared with outside parties for promotional or other purposes unrelated to products you order from us. As explained above, when you order a magazine, the product provider may ask for your billing address, your phone number and credit/debit card information. This information will be used only to process your order and send you the product you requested. We, or the product provider will normally only use your phone number in the event of a problem with your order. That information will not be shared with anyone else (unless an outside company is part of the process of fulfilling your order).

Friend/family members' information

If any of our products you use are intended for a family member or friend, their information will never be sold, shared or rented, and we will not use their information for promotional or other purposes unrelated to the product you ordered or had sent to someone else. We will use the information gathered only to process the order or to e-mail acknowledgment of fulfillment. Recipients may receive notification of the product gift and an e-mail introduction describing ourselves and our services. Unless the recipient visits our site and personally registers to become an Associate or Independent Sales Representative, his or her information will not be added to our active mailing list, but will only be retained in our database for accounting and current or future customer service purposes.

General demographic information

We may share general demographic information with our marketing partners so that they may better serve you. For example, we may tell one of our partners that a certain number of members have expressed interest in a certain product/service, or that a certain number of members are reading our Newsletter.

Children's information

We believe that protecting the privacy of children is crucial. Therefore, we do not knowingly collect or maintain information at our website from children under age 18, and no part of our website is structured to attract those under 18.

Also like most other Web sites owners, we may use IP addresses to analyze trends, administer the site, track users' movements inside the site, determine which site referred users to us, and gather very general demographic information, in the interest of better serving our members and streamlining our operations. IP addresses are not linked to personally identifiable information.

What You Should Know About the Future

We are committed not only to your privacy, but to our own success. However, if another company ever acquires us, all of our assets, including the information we have gathered, become the property of the new owner. If this happens, the new owner's policies may override our privacy policy described herein. Also, if we ever goes out of business, all of our assets, including the information we have gathered, may be sold or dissolved.

RETURN POLICY

While the majority of our products and services are offered and delivered via eCommerce methods, we do offer a 30-day money-back guarantee on all of our services and products. If a customer is dissatisfied with any of our services or products, for any reason, users can return it for a full refund (excluding any shipping and handling fees) within 30 days of purchase.

All refund requests should be made prior to returning the product to us. Send us your Product Return request or contact our Customer Service Department to be issued a Returned Merchandise Authorization (RMA) number. This RMA number should be clearly marked on the returned package.

All returns must be made within 30 days of purchase and must include all packaging and product materials.

We recommend sending returns through a traceable courier. We are not responsible for packages that get lost in transit. The customer will absorb the costs of return shipping.

Upon receipt of the return we will credit back the product purchase price in the form that the original payment was made. Credit cards will be credited back to the same card. Paid Purchase Orders will be issued a refund check or credit to bank account used for the purchase. Purchase Orders for which we have not yet received payment will be canceled. Shipping and handling charges will not be refunded.

Delivery Methods and Timing

When delivery methods, other than eCommerce methods, are used in providing our customers with their product/service, delivery methods will be described on the website with allowance for delivery within 4 to 6 weeks.

DISCLAIMERS

We are responsible for the content of our websites and closely monitor the content of any of our marketing partners in order to maintain the highest standard of website presence. However, we cannot be legally responsible for errors in our marketing partners data presented on our websites.

Non-Spam Policy

We have a strict non-spam policy and will pursue whatever legal steps are necessary to enforce this policy. "Spam," or "Spamming," is also known as Unsolicited Commercial Email (UCE) or Unsolicited Bulk Email (UBE).

Unsolicited Commercial Email is typically defined as the sending of any email message to anyone not personally known by you unless it is in specific response to a request for information from you. This definition is independent of how and by whom the email is actually sent.

Unsolicited Bulk Email is typically defined as the broadcasting of large quantities of unsolicited Email or postings to news groups through any large quantity delivery system. This definition is independent of how and by whom the email is actually sent.

Our policy on Spam is strict and WILL BE enforced for the benefit of all of our representatives and customers. There are many ways to promote your web page without the use of Spam. There are numerous reasons for everyone to adhere to this Non-Spam policy. It could only take one Independent Sales Representative to violate this policy to result in all of our websites being taken down by our Internet Service Provider. Our Non-Spam policy is for the protection of all of our representatives, consumers and the company. Continuous on-line operation is essential. Anything less reduces revenues and profits for everyone.

After a complaint and an investigation, if anyone is found to have spammed, their website will be terminated and their position as an Independent Sales Representative will be reviewed for possible further action. We will remove your web page and no refund will be issued for the unused portion of your hosting fees. We have the responsibility to determine what violates this policy. If you have any doubts concerning acceptable practices, then it is ESSENTIAL that you contact US BEFORE you act. Obviously, the Internet is at the heart of our eMarketing business. Consequently we absolutely must protect it for the sake of our customers, representatives, providers and the company.

Do NOT be confused over points of law. The Attorneys General for each state are concerned about the well being of their citizens. Good corporate citizenship within each state is essential for any network marketing company. Spam and Faxing are upsetting more and more people within each state and they are complaining to their own Attorneys General.

Our Non-Spam and Non-Faxing policies are about being a good corporate citizen in all states. This eliminates the need for discussions about what is, or is not legal, because it is based on treating our prospective customers and representatives the same way we would want to be treated.

SPECIAL CAUTIONS - Please make sure you understand the following:
1. Ignorance of the contents of this policy will not be an acceptable excuse.
2. There are NO acceptable disclaimers that can be added to an unsolicited message that will make the message acceptable. This includes but is not limited to remove instructions, remove links, legislative compliance statements, or general statements as to possible interest in a business opportunity.
3. We do NOT recommend the use of any purchased lists of email addresses. Use of any purchased list of email addresses puts your membership at risk if there are any complaints due to problems with the list being out of date, poor quality, improperly gathered, etc.
4. Use of any marketing company that sends your advertisement to their list puts your membership at risk if there are any complaints due to problems with the list being out of date, poor quality, improperly gathered, etc.
5. It is NOT acceptable to send someone a message about us just because you received an unsolicited message from him or her.
6. It is NOT acceptable to make uninvited approaches to "Instant Messenger" members.
7. It is NOT acceptable to post any advertising messages to any news groups.
Just because you see such messages posted does NOT give you permission to do the same.
8. It is NOT acceptable to use our invitation system to send messages to anyone other than friends, relatives and acquaintances you are on a first name basis with and know will not complain.

If you have any questions about these policies, please contact us.
